Terms of Warranty

For the purposes of this Warranty the following definitions are used: 

 

Approved Servicer means an independent service contractor appointed or approved by HPPS to service the Product; 

Certificate of Compliance is a certificate issued by a licensed tradesperson qualified to certify that the 
installation complies with applicable regulatory requirements; 

Instructions include the manual for the Product and all operating instructions; 

Product means the Heat Pump Swimming Pool / Spa Heater/Cooler purchased and described in the Schedule;

Purpose is the use of the Product for the heating / cooling of water used in residential or commercial swimming pools.

Qualified Installer is a person licensed to install the Product and to certify the installation meets all regulatory requirements.

Site means the address at which the Product is to be installed;

 

This warranty is given to purchasers of new heat exchange pool heaters purchased from and/or installed by HPPS. It covers: 

  • a 10 year warranty on the stainless steel casing;  
  • a 15 year warranty on the titanium heat exchanger;
  • a 3 year warranty on all other parts;
  • damage arising from improper or faulty installations by HPPS;
  • repairs to the Product arising from defective parts supplied by HPPS

The warranty does not cover: 

  • Improper use of the Product or failure to read the Instructions;
  • damage caused by improper use or operation or inadequate maintenance;
  • unsatisfactory performance arising from climatic conditions or siting of the Product;
  • improper or faulty installation by a third party not appointed by HPPS;
  • damage, problems or failure caused by acts of God, fire, wind, lightning, flood, storm, hail storm fallout, vandalism, earthquake, war, civil insurrection, misuse, abuse, negligence, accident, pests, animals, pets, vermin, insects, spiders/bugs or entry of foreign objects or matter into the Product such as dirt, debris, soot or moisture
  • any claim for indirect, consequential loss, economic loss, damage to property or personal injury.
  • any claim with regards to the Wifi functionality of any Product

 

Requirements of Purchaser

 

Before making a warranty claim the Purchaser must:

  • provide proof of purchase from HPPS;
  • have read and followed the Instructions in the operating manual;
  • have spoken to the Qualified Installer of the Product seeking advice;
  • properly maintained the Product including provision of air flow, adequate clearance, regular cleaning and maintenance, including replacing batteries where required.

 

Terms of Warranty

 

  1. The Product is warranted by HPPS to be free from defective materials or workmanship for the period set out in the Schedule. 
  2. If repairs, or replacement, of defective parts of the Product is required then:
    1. an Approved Servicer will carry out the repairs.
    2. these repairs shall be carried out between  8.30am and 5pm on a weekday
    3. the Purchaser will provide safe access to the Product and pay any additional charges to gain safe access, travel costs (exceeding 30km) and service outside the above times.
  3. The Purchaser shall conduct regular checks and maintenance on the Product as required by the Instructions.  Failure to do so voids this warranty.  
  4. The Purchaser must advise HPPS within 30 days of a defect arising affecting the Product to make a valid claim under this warranty. 
  5. If repairs are made to the Product other than by an Approved Servicer this warranty shall become void.
  6. The Product must have been installed by a Qualified  Installer for this Warranty to be valid and enforceable.
  7. This warranty is not transferable except with the written consent of HPPS. 
  8. To be clear, if not expressly noted as per Term 1 of the Warranty above, the date on which the Warranty coverage period commences is the date the Product is delivered to the Site in accordance with the Purchaser's instructions.
